Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) governs your use of the Kiara API and any content you create, transmit, or generate through it. It applies to you, to anyone using your account or API keys, and to your own end users. By using the Kiara API you agree to this AUP, which is incorporated into our Terms of Service. We may update this AUP from time to time; continued use after a change means you accept it.
1. 18+ only
The Kiara API is strictly for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use the service. If you build a product on top of the Kiara API, you are responsible for age-gating your own end users and ensuring that every person who interacts with the service through your integration is also 18 or older.
2. Prohibited content and conduct
The following are strictly prohibited with zero tolerance. We enforce this section automatically and on report. Violations result in immediate account termination, and we will preserve evidence and report illegal material to law enforcement and, where applicable, to the National Center for Missing & Exploited Children (NCMEC). You must not use the Kiara API to create, request, store, transmit, or distribute:
- Any sexualization or exploitation of minors. This includes child sexual abuse material (CSAM) and any content that sexualizes, endangers, or exploits anyone under 18, real or fictional, regardless of style, framing, or claimed age.
- Non-consensual intimate imagery. Sexual, nude, or pornographic depictions of real, identifiable people created or shared without their explicit consent, including so-called “revenge” content and synthetic intimate imagery.
- Impersonation and deepfakes of real individuals. Using a real person’s name, face, likeness, or voice without their consent, or creating content designed to deceive others into believing a real person said or did something they did not.
- Infringing or rights-violating content. Content that infringes any copyright, trademark, or other intellectual-property right, or that violates anyone’s privacy or publicity rights.
- Illegal and abusive activity. Any illegal content or activity, including fraud, scams, spam, phishing, malware, harassment, doxxing, threats, and stalking.
- Extreme violence and dangerous instructions. Gratuitous gore or extreme violence, and instructions or facilitation for weapons, including biological, chemical, radiological, nuclear, or other weapons of mass destruction.
- Privacy, surveillance, and biometric abuse. Generating content to identify, track, profile, or surveil individuals without a lawful basis, or to infer or expose sensitive attributes about real people without their consent.
- Disinformation and electoral manipulation. Content intended to deceive about matters of public importance, including coordinated inauthentic behavior, fabricated “news,” and content designed to interfere with elections or democratic processes.
- Sanctions and export violations. Use by, or on behalf of, persons or in territories subject to applicable sanctions or export-control restrictions, or any use that would cause us to breach such laws.
- Spam, scraping, and infrastructure abuse. Sending unsolicited bulk content, automated scraping or harvesting beyond documented limits, denial-of-service activity, or any use that imposes an unreasonable load on the service.
- Defeating our safety systems. Circumventing, probing, or attempting to defeat any of our safety, moderation, or rate-limiting systems, or instructing others to do so.
3. Reselling and competing services
You may build and sell your own products and applications on top of the Kiara API. You may not, however, resell, sublicense, or otherwise redistribute raw API access, nor operate a proxy, timesharing, service-bureau, or competing generation service that exposes the Kiara API to third parties as a substitute for their own account.
4. AI-generated output
All images and video produced through the Kiara API are AI-generated. You must not misrepresent generated output as human-made, and you should clearly disclose the use of AI to your end users and audiences wherever doing so is appropriate or required by law or platform policy.
5. No model training on output
You may not use any output generated through the Kiara API to train, fine-tune, or otherwise develop any machine-learning or AI model, nor to build a dataset for that purpose.
6. Your responsibility for end users
You are fully responsible for all activity that occurs through your account and API keys, including the conduct of your own end users. You must pass through, and enforce against your end users, terms at least as protective as this AUP, and you must promptly act on any abuse you become aware of within your product.
7. Enforcement
We may investigate suspected violations and, at our sole discretion, suspend or terminate accounts, block access, remove or disable content, withhold output, and report illegal content and activity to law enforcement and other authorities — with or without prior notice. We may take these actions for any violation of this AUP or our Terms of Service.
8. Consequences of violation
Depending on the severity of the violation, consequences may include a warning, throttling, removal or withholding of content and Outputs, temporary suspension, or permanent termination of your account with forfeiture of unused credits to the extent permitted by law. For illegal content — in particular any material that sexualizes minors — we apply zero tolerance: we terminate immediately, preserve evidence, and report to law enforcement and the relevant authorities. We may also pursue any other remedies available to us, and you remain responsible for indemnifying us as set out in the Terms of Service.
9. Reporting abuse
To report content or activity that violates this AUP, contact abuse@kiara-api.com. Please include any relevant identifiers (such as the time of the request or an asset URL) so we can act quickly. We review every report and respond to credible reports of illegal content as a priority.
